1. Welcome to Postava
These Terms of Use (“Terms”) are a legal agreement between you and Appercut Sp. z o.o. (“we”, “us”, or “our”), a Polish company registered at ul. Twarda 18, 00-104 Warsaw, Poland (KRS: 0000775831, NIP: 5252783211). They govern your use of the Postava mobile application (“App”), available on the Apple App Store and Google Play Store.
By downloading, installing, or using the App, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the App.
In short: by using Postava, you accept these rules. Our Privacy Policy explains how we handle your data.
2. What is Postava
Postava is a mobile app which, based on a survey, selects a personalised exercise programme for the user’s back, shoulders and hips. Within the App itself, the programme is also adapted to the user’s progress and preferences.
We may update, modify, or discontinue any feature of the App at any time without notice. Your use of the App does not entitle you to the continued availability of any specific feature.
In short: Postava prepares a personalized exercise plan for back, shoulders and hips. Features may change over time.
3. Who can use Postava
You must be at least 18 years old to use the App. By using the App, you confirm that you are 18 or older and that you are legally able to enter into this agreement.
If we learn that someone under 18 is using the App, we will immediately terminate their access and delete their data.
In short: you must be 18 or older.
4. Starting to use the App
To start using the App, you need to follow the steps described below.
Survey
To start using the App, you’ll need to complete the survey available in the App or on our website.
In the first stage of the survey, you will be asked about your gender and age group. You will also be asked to indicate the areas of your body where you experience pain, discomfort or tension, and to describe the type and nature of the ailments in those areas.
Consent for health data processing
Once you have selected the relevant body parts, you will be asked to consent to our processing of your health data, along with a link to our privacy policy. Giving your consent is voluntary, but you cannot use the App without giving your consent – in order for us to prepare a personalized plan for you, we need to know about the health issues you are experiencing.
Until you give your consent, the information you provide is stored only locally (on your device). Your responses are only saved in our database once you have given your consent.
Completing the survey
Once you have given your consent, you will be asked a set of further questions:
- specific questions related to your ailments – for each area of the body you indicate, you will receive a separate set of questions with possible answers.
- safety screening – this is an important step during which you will be asked about serious medical conditions from a provided list. This section serves solely to prevent users for whom the App is not recommended from proceeding – if a user has any of the medical conditions for which the use of the App is not recommended, a training plan will not be created, and the user will be advised to consult a doctor.
- questions regarding lifestyle.
- questions regarding training preferences.
Providing e-mail address
Once you have completed the survey, you will be asked to provide your email address. When you provide your email address, your responses will be linked to that address.
Buying a subscription
In the next step, you will have the option to purchase access to the App. Access to the App is provided on a subscription basis. Details regarding the subscription and how to purchase it are set out in section 7 below, ‘Subscriptions and payments’.
In short: using the App is only possible after filling out a survey. We will be processing your health data, but only after your consent.
5. Using the App
Exercise plans
Once you’ve taken out a subscription, you’ll receive a personalized exercise plan. As you use the App, we’ll record details of your workouts and progress, and ask you further questions to help improve your plan.
Changing devices
Your data is linked to your account and stored in our cloud. This means you can change your device at any time and continue exercising where you left off.
General rules
Don’t use the App to:
- break any law or violate anyone’s rights;
- interfere with the App’s operation or security;
- reverse engineer, decompile, or copy the App;
- bypass security features;
- use bots, scrapers, or automated tools;
- use the App commercially (reselling generated exercise plans, etc.).
In short: your personalized plan will be further improved with your use of the App. Always be legal.
6. Our use of AI
Postava uses AI in accordance with the principles described below.
What we use AI for
We use AI to select a suitable set of exercises for the ailments you have specified. The exercises are selected by an AI model from our own catalogue.
Please bear in mind that – given their nature – the use of AI tools carries a risk of errors and inaccuracies.
What we DO NOT use AI for
We do not use AI during the survey-completion stage. The algorithm used to classify the ailments you have indicated is not based on AI.
Which data we share with the AI provider
We may pass on all the information you provide to the AI model, with the exception of your email address and user IDs.
We use Anthropic’s Claude model via the official API.
Use of data for training of the AI model
Once we have received separate consent from the user, we may use the data to train AI and improve the selection of programmes.
In short: We use AI to select exercises. AI isn’t perfect. We share your data with the AI provider, but without e-mail or identifiers. With your consent, we may use your data to train the AI model.
7. Subscriptions and payments
Subscription
A subscription is required to use the App. We use a third-party service to manage subscriptions.
How payments work
Payments may be processed by Stripe or PayPal. We share your e-mail address with the payment providers. We do not collect or store your payment information.
Auto-renewal
Subscriptions automatically renew at the end of each period unless you cancel before the renewal date.
Free trials
We may offer free trials. At the end of the trial, your subscription automatically converts to paid unless you cancel before the trial expires. Free trials are for new users only.
How to cancel
You can cancel anytime. The cancellation method depends on how you bought the subscription:
- if you bought the subscription on our website – cancel through the Billing Center or by contacting us on WhatsApp or by e-mail,
- if you bought the subscription on App Store – cancel directly through App Store,
- if you bought the subscription on Google Play – cancel directly through Google Play.
You’ll keep access until the end of the current paid period. We do not offer refunds for unused time, except where legally required. Deleting the App does not cancel your subscription — you must cancel it separately.
Price changes
We may change subscription prices. We’ll notify you in advance. New prices take effect at the next renewal. If you disagree, cancel before the renewal.
In short: payments go through Stripe or PayPal. Cancel by contacting us, through App Store or through Google Play – depending on how you bought the subscription, not by deleting the App.
8. Our intellectual property
Everything in the App (design, software, algorithms, trademarks, logos), except your data & information, belongs to us or our licensors. You get a limited, personal, non-commercial, non-transferable, revocable license to use the App. You may not:
- copy, distribute, or publicly display any part of the App;
- modify, reverse engineer, or create derivative works;
- sell, rent, or sublicense the App;
- use our trademarks or design elements outside the App;
- scrape or extract data from the App.
If you share feedback or ideas with us, you grant us the right to use them without compensation or attribution.
In short: the App is ours, your data is yours. Don’t copy or reverse engineer the App.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or secure. We are not liable for the user’s performance of the exercises, including any injuries sustained as a result of performing the exercises incorrectly. We do not guarantee any results from performing the exercises. We do not warrant the accuracy of AI-based decision making.
Regardless of the measures we undertake to secure the App and our website, due to the public nature of the Internet and the use of electronically provided services, you should be aware of the risk that unauthorized persons may obtain and modify your data. Therefore, in order to ensure the security of your equipment and data, as well as to safeguard our security, you should also implement appropriate technical and organizational measures to protect data, information, and functions.
These disclaimers do not affect consumer rights that cannot be waived by law.
In short: we provide the App as-is and can’t guarantee perfection.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY ARISING FROM THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR €10, WHICHEVER IS GREATER.
Nothing in these Terms limits our liability for fraud, intentional misconduct, death or personal injury caused by our negligence, or any liability that cannot be limited by law.
In short: our liability is limited to what you’ve paid us. This doesn’t apply to things we can’t legally limit.
11. Your responsibility
You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from:
- your use of the App;
- your provision of data;
- your violation of these Terms;
- your violation of any third party’s rights.
In short: if your actions cause us harm, you’re responsible.
12. Termination
By accepting these Terms, you enter into an agreement with us, which you may terminate by deleting your data, uninstalling the app, and - if you have an active subscription - canceling your subscription (see Section 7 ‘Subscriptions and payments’, subsection How to cancel above).
We may suspend or terminate your access at any time, with or without cause, with or without notice. We will terminate immediately if you violate these Terms, especially the prohibited content rules.
Upon termination, your license to use the App ends. We may delete your data. Termination doesn’t relieve you of obligations incurred before termination.
Sections 5 (Using the App), 8 (Our IP), 9 (Disclaimers), 10 (Limitation of liability), 11 (Your responsibility), and 13 (Governing law) survive termination.
In short: we can end your access if you break the rules. Some obligations continue after termination.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Poland. Disputes will be resolved by the competent courts in Warsaw, Poland, unless the law provides for the exclusive jurisdiction of another court.
Any complaints regarding the App may be submitted using the contact details specified in these Terms. In your complaint, please include your e-mail address provided within the survey, a description of the issue, and, if applicable, your request. We may ask for additional information. We will respond to your complaint and let you know whether we have accepted it.
For EU users: nothing in these Terms affects your rights under mandatory consumer protection laws in your country. You retain your right of withdrawal within 2 weeks and we remain legally responsible for the App’s compliance with these Terms. You may also use the European Commission’s Online Dispute Resolution platform at https://consumer-redress.ec.europa.eu/index_pl.
For U.S. users: to the extent permitted by law, disputes will be resolved through binding individual arbitration, not class actions. You waive any right to participate in class-action lawsuits or class-wide arbitration.
In short: Polish law applies. EU consumers keep their local rights. U.S. disputes are resolved individually.
14. App Store terms
Apple App Store
If you downloaded the App from Apple’s App Store, you acknowledge that:
- these Terms are between you and Appercut, not Apple;
- Apple has no obligation to provide maintenance, support, or warranty for the App;
- in the event of the App’s failure to conform to any warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no further warranty obligation;
- Apple is not responsible for any claims related to the App, including product liability, legal compliance, or IP infringement;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
Google Play Store
If you downloaded the App from Google Play, your use of the App is also subject to Google Play’s Terms of Service. In the event of a conflict between these Terms and Google Play’s terms, the more restrictive provision applies.
In short: Apple and Google have their own rules that also apply. These Terms don’t replace theirs.
15. Changes to these Terms
We may update these Terms at any time. If we make material changes, we’ll notify you within the App. The updated Terms will include a new effective date.
Your continued use after the effective date means you accept the changes. If you disagree, stop using the App.
16. General
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us regarding the App.
Severability. If any provision is found invalid, the rest remain in effect.
Waiver. Our failure to enforce a right doesn’t waive it.
Assignment. You can’t transfer these Terms. We can.
No third-party beneficiaries. Except as stated in Section 14 for Apple, no third party has rights under these Terms.
